Judicial Panel Concurs to Reconsider Case

The ninth circuit court of appeals ruled on this week that it would reexamine the legal dispute concerning the executive power with an larger group of eleven justices. The judicial body also overturned a previous decision from a smaller judicial group that had sided with the federal government.

Ongoing Dispute Over Military Presence

This order represents the most recent turn in a protracted court case over whether the administration has the legal right and justification to deploy national guard forces in the city. Approximately 200 federalized guard members have been in limbo since the end of September when the deployment effort was started in response to months of protests.

Conflicting Arguments

The federal government has argued that federal officials at the ICE facility in the southern part of the city were facing threats, while city and state officials assert that municipal police have control of the circumstances.

Contrary to descriptions of the city as a conflict zone, locals have been sharing footage of scenic paths and a vibrant culinary culture, and planning events such as an protest bicycle event against the increased military presence.

Court Proceedings

The appeals court decision came after a federal judge in Portland enacted two temporary restraining orders this period – one preventing the federalization of the Oregon national guard, and another stopping the use of any military personnel in Oregon, after attempts to evade the first order by mobilizing out-of-state forces.

On Monday, the ninth circuit panel had put the first ruling on hold – permitting control of state troops – but the second ruling stayed effective, blocking the actual deployment of the troops.

En Banc Review

The latest ruling means the issue will be heard “en banc” – with all decisions under consideration together – by a group of eleven justices.

“This decision shows that the truth matters and that the courts are striving to hold this administration accountable. The constitution restricts the president’s power, and local populations cannot be treated as a training ground for unchecked federal authority,” stated the legal representative in a official comment.

“The judicial body is sending a clear message: the president cannot send the military into American urban areas without cause. We will continue protecting Oregon’s laws, principles, and autonomy as this legal proceeding moves forward and our fight continues in the courts.”
